Statement on "Sullivan II" and the Faculty Senate

At its meeting of November 21, and by email on November 22, the Faculty Consultative Committee deliberated at length what the response of the governance system should be now that the faculty of the Crookston and Morris campuses and the Academic Health Center have voted against collective bargaining.

On October 24, the Faculty Senate voted 121-1 to request that the Board of Regents take no action on a tenure code proposal for any unit of the University until all of the collective bargaining elections had been held. The Faculty Consultative Committee does not believe it should act in a way that violates the directive of the Faculty Senate. At the time of the Faculty Senate vote, however, the Sullivan II proposal had not been written and, of course, the Regents had not adopted it for the Law School. Nor had any units voted against collective bargaining. At this time, the Regents have the authority to adopt Sullivan II for the three units that have voted against collective bargaining, and have placed the issue on their docket for their December 13 meeting.

A number of faculty have opined that Sullivan II should be acceptable to the faculty. The Faculty Consultative Committee is cognizant that for many faculty, especially those in the units that will not have collective bargaining, resolution of the tenure issue is of paramount importance. FCC has thus concluded it should ask the Faculty Senate, on December 5, whether the body wishes to again consider tenure. Several options are available, of which two are most obvious:

  1. The Faculty Senate can vote to reaffirm its October 24 resolution.

  2. The Faculty Senate can ask the Tenure Subcommittee, the Committee on Faculty Affairs, and the Judicial Committee to review Sullivan II and to make recommendations to the Faculty Senate at a special meeting that would be called on December 12. The Faculty Senate, in turn, could then issue a recommendation to the Board of Regents before the December 13 meeting.

To consider these options, there will be a Faculty Senate meeting on December 5, after the University Senate and Twin Cities Campus Assembly meetings, at which time the tenure question will be on the agenda and the Faculty Consultative Committee will ask the body to indicate its wishes.
