(a)    The Company agrees that in the event of installation of new or improved machinery or processes for work covered in the jurisdiction clause of this Contract, such machinery or processes must be operated by employees covered under this Contract and under the scale of wages and conditions of work agreed upon this Contract.  Furthermore, staffing shall be discussed and wherever possible will be operated in accordance with the practice of the Industry in the Twin Cities, provided the method of operation, type of product produced and auxiliary equipment (if any), is the same.

The Company will notify the Union in writing ninety (90) days prior to the installation of new or improved machinery or processes for work covered in the jurisdiction clause of this Contract, or the day of purchase, which-ever is lesser and will meet with the Union upon written request, to thoroughly discuss that new machinery or processes.

An employee displaced because of a new machine or process shall not be subject to layoff before any employee with less seniority, until the displaced employee has been retrained or the employee refuses retraining or fails to qualify after a reasonable period of time. In those cases where the parties disagree on manning of equipment based on the practice of the Industry in the Twin Cities, the decision of whether the Employer has equipment which has the same method of operation, type of product produced and auxiliary equipment (if any), may be submitted to arbitration by either party.
