The right to a clean and a wholesome environment has been elevated to the status of a fundamental right. In the Rural Litigation & Entitlement Kendra Dehradoon vs. State of U.P. reported in All India Reporter 1985 Supreme Court 652, the Supreme Court held that the right to a clean environment is a part and parcel of the right under Article 21 of the Indian Constitution.
