The Council of Courts Chairpersons


 

The Council of Courts Chairpersons, Republic of Armenia (henceforth Council of Courts Chairpersons) is a self-governing body of judiciary power acting on permanent basis, the authorities of which are stated in the 10th chapter, entitled “The Autonomy of Judiciary power”, of the Judicial Code of Republic of Armenia

The Chairpersons of the Courts of First Instance and Appeal, the Chairman of the Court of Cassation and Chairpersons of its chambers are members of the Council of Courts Chairpersons. Officially the Chairman of the Council of Courts Chairpersons is the Chairman of the Court of Cassation. In the absence of the Chairman of the Court of Cassation the Council of Courts Chairpersons is chaired by a substitute person to the Chairman of the Court of Cassation. 

The Council of Courts Chairpersons:

    1. Performs the self-governance of the judiciary power in the Republic of Armenia, discusses any issue concerning the ensuring of the regular activities of the judiciary power with the exception of issues prescribed by law to the Commissions of the Council of Courts Chairpersons. 
    2.  Makes suggestions to competent state bodies on improvement of laws and other legal acts 
    3. Approves the rules of functions the courts correspondence 
    4. Makes decisions which are subject to necessary implementation by Judicial Department of Republic of Armenia (henceforth Judicial Department) 
    5. Approves the passports of the offices of judiciary service 
    6. According to structural and separated subdivisions, approves the name index and the number of positions of the offices of judiciary service 
    7. States the order of holding closed competition for vacant positions in judiciary service, as well as the order of attestation, holding an interview and evaluating the qualifications of candidates in an open competition, the order of formation of competition commissions and their standing orders 
    8. Approves the order of trainings for the judges and judiciary servants 
    9. Performs the general governance of the activities of the Judicial Department 
    10. Performs other authorities prescribed to it by law.


      According to article 73 of Judicial Code of Republic of Armenia, the Chairman of the Council of Courts Chairpersons:

    11. Chairs the Council of Courts Chairpersons 
    12. From amongst the judges of the Court of Cassation appoints one judge for involvement in the Commission of Attestation of the Solicitors Chamber 
    13. Presents the candidacy and the dismissal suggestions of the head of the Judicial Department to the Council of Courts Chairpersons 
    14. Performs the general governance of the activities of the Judicial Department 
    15. Appoints a temporary substitute in case of vacancy of the chairman of the Courts of First Instance or Appeal 
    16. In discovering a violation of the requirements of the Judge Discipline legislation, respectively sends a report concerning that issue to the Ethics Commission of the Council of Courts Chairpersons or to the Discipline Commission of Judicial Council of Republic of Armenia
    17. Represents the judiciary power in its relations with other bodies 
    18. Performs other authorities prescribed to him/her by law 

      The Council of Courts Chairpersons acts according to its confirmed legislation. 

      By decision 02L from August 10, 2006, the Council of Courts Chairpersons from its composition formed the following commissions on 

 

    1. Ethics issues. 
    2. Judicial Department issues. 
    3. Judiciary practice and statistics issues. 
    4. Studying issues 
    5. Budget issues. 

      Each commission is chaired by a member elected by the commission from its composition. The number of the members of commissions is fixed by the Council of Courts Chairpersons.
